‘A High Court decision, Thomas v Cheltenham Borough Council has been recently upheld by the Court of Appeal following challenge. This decision directly contradicts Welsh Government planning guidance. Swansea Council (and Councillors) are now in the position whereby they can either follow the High Court, or continue to follow Welsh Government’s outdated guidance, which is now contrary to this legal ruling. Councillor Chris Evans points out that continuing to follow such guidance opens up legal liability for the council that could run into hundreds of thousands if not millions of pounds.’
